1. Acceptance of these Terms
These Terms of Use are entered into between you and the Plant a Seed & See What Grows Foundation (“the Foundation,” “we,” “us”), a registered Canadian charity (Charitable Registration Number 80622 2832 RR0001). They govern your access to and use of seewhatgrows.org, including all content, functionality, and services offered on it (the “Site”). By using the Site, ordering free program resources, making a donation, or submitting any form, you accept these Terms of Use and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.
The Site is offered primarily to users who reside in Canada. Forms, applications, and orders are intended for adults — by submitting them you represent that you have reached the age of majority where you live and are legally able to enter into this agreement, or that you are authorized to act for a school, library, daycare, or other organization.
2. Changes to these Terms and to the Site
We may revise these Terms from time to time; changes take effect when posted, and your continued use of the Site means you accept them. We may also update, add, or remove Site content and programs at any time, and we may restrict or withdraw access to any part of the Site without notice. We are not liable if the Site is unavailable at any time.
3. Free program resources
Our program kits — storybooks, workbooks, colouring books, and seeds — are provided free of charge to eligible Canadian schools, public libraries, daycare centres, and community organizations. When you submit a request form, you agree that the information you provide is accurate, current, and complete. All requests are subject to acceptance and availability, and we may decline or limit any request at our discretion. Resources are provided for educational use by your school, classroom, library, or organization — not for resale or commercial use. We deliver only to complete street addresses in Canada (no PO boxes).
4. Garden grants and applications
School garden grants, Create a Garden projects, and similar opportunities are subject to the eligibility criteria, deadlines, and funding limits published for each program. Submitting an application does not guarantee approval, funding, or participation. We may verify the information you provide, request supporting documentation, prioritize applications according to need and available funds, and decline or modify any application. Funds are provided for the purpose set out in the approved application, and we may ask for confirmation of how they were used.
5. Donations, receipts, and the shop
Donations are processed by a third-party donation platform, and shop purchases through shop.seewhatgrows.org and its payment provider; their terms and privacy practices also apply. When you donate or purchase, you confirm that your information is accurate and that you are authorized to use the payment method.
Official donation receipts are issued only where the gift is eligible under the Income Tax Act (Canada) and the Canada Revenue Agency’s rules, and where we hold the information required to issue the receipt. Benefits or goods received in connection with a contribution may reduce the eligible amount.
Donations are generally final. If you believe a donation was made in error, duplicated, or made without authorization, please contact us promptly; any refund is subject to applicable law, receipting requirements, and the payment provider’s rules. Recurring gifts continue until cancelled; cancelling stops future charges but does not reverse past gifts.
6. Our content and your use of it
The Site and its contents — including the storybooks, workbooks, colouring books, illustrations, characters, videos, text, and design — are owned by the Foundation or its licensors and are protected by Canadian, United States, and international copyright, trademark, and other intellectual-property laws.
We want our resources used! You may download, print, and reproduce our free PDFs and activity materials for personal, classroom, library, and other non-commercial educational use. You may not sell our materials, modify them or create derivative works from them, remove any copyright or credit notices, or use any illustration, character, or audio/video content separately from its accompanying material. For any other use, ask us first: info@seewhatgrows.org.
7. Trademarks
“Plant a Seed & See What Grows,” the Foundation’s logos, and its program names (Seeds of Inspiration, Seedlings of Wonder, Plant a Seed—Read!, Kids Corner) are trademarks of the Foundation. Other names and logos appearing on the Site belong to their respective owners. No licence to use any trademark is granted by the Site.
8. Acceptable use
You may use the Site only for lawful purposes. You agree not to: use the Site in any way that violates applicable law; attempt to exploit or harm minors in any way; impersonate the Foundation or any other person; send spam or promotional solicitations through the Site; introduce viruses or other malicious code; attempt to gain unauthorized access to the Site or its servers; use robots, scrapers, or other automated means to access the Site without our written consent; or otherwise interfere with the Site’s proper working or another person’s use of it.
9. Submissions (contest entries, photos, testimonials)
From time to time we invite submissions — for example, contest entries, classroom photos, garden stories, or testimonials (“Submissions”). By making a Submission, you grant the Foundation a non-exclusive, royalty-free right to use, reproduce, and display it, with attribution, for the Foundation’s charitable and promotional purposes. You confirm that you own or control the rights to what you submit, that you have permission from any person appearing in it, and — for any work created by a child — that you are the child’s parent, legal guardian, or teacher with the parent’s consent. We may decline or remove any Submission at our discretion. Submissions must not contain unlawful, infringing, or objectionable material.
Information you send privately through a contact, donation, application, or resource-request form is handled under our Privacy Policy and is not treated as a public Submission.
10. Copyright complaints
We respect the intellectual property of others. If you believe material on the Site infringes your copyright, send a notice to info@seewhatgrows.org containing the information set out in section 41.25 of the Copyright Act (Canada): your name and address, the work and the material in question, the location of the material, and a statement of the infringement claimed.
11. Information on the Site
The information on the Site is provided for general educational purposes. While we work to keep it accurate and current, we do not warrant its completeness, and any reliance you place on it is at your own discretion. Gardening and planting activities for young children should always be supervised by an adult.
12. Third-party links
The Site links to third-party sites and services — including our donation platform, our online shop, and embedded videos — for your convenience. We do not control and are not responsible for their content or practices; your use of them is governed by their own terms and policies.
13. Linking to the Site
You are welcome to link to the Site in a way that is fair, legal, and does not suggest endorsement or association without our written consent. We may withdraw linking permission at any time.
14. Disclaimer of warranties
YOUR USE OF THE SITE AND ITS CONTENT IS AT YOUR OWN RISK. THE SITE AND ALL RESOURCES ARE PROVIDED FREE OF CHARGE, ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES, CONDITIONS, OR RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING UNDER CONSUMER PROTECTION LEGISLATION.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE, ANY SITE LINKED TO IT, OR ANY RESOURCES OBTAINED THROUGH IT, INCLUDING ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
16. Indemnification
You agree to defend, indemnify, and hold harmless the Foundation and its directors, officers, employees, volunteers, and service providers from claims, damages, and reasonable costs (including legal fees) arising out of your violation of these Terms or your Submissions. This does not require you to indemnify anyone for their own negligence or unlawful conduct.
17. Governing law and disputes
These Terms and any dispute arising from them or the Site are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any rights you may have under mandatory consumer protection or other laws, any legal action shall be brought exclusively in the courts of British Columbia, and you consent to their jurisdiction.
18. Waiver, severability, and entire agreement
Our failure to enforce any provision of these Terms is not a waiver of it. If any provision is held invalid or unenforceable, the remaining provisions continue in full force. These Terms and the Privacy Policy are the entire agreement between you and the Foundation regarding the Site.
