Terms of Use

1. Agreement to These Terms
These Terms of Use are an agreement between you and Plant a Seed & See What Grows Foundation (the “Foundation,” “we,” “us,” or “our”). They govern your access to and use of seewhatgrows.org and any related pages, forms, features, downloads, educational materials, donation tools, resource-ordering tools, and services that link to these Terms (collectively, the “Site”).
Please read these Terms before using the Site. By accessing or using the Site, submitting a form, requesting resources, making a donation or purchase, or otherwise indicating your acceptance, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
Additional terms may apply to a particular program, event, application, contest, donation campaign, purchase, or service. If those additional terms conflict with these Terms, the additional terms will govern that specific activity.
2. About the Foundation and Operational Support
The Site is operated for Plant a Seed & See What Grows Foundation, a Canadian registered charity. The Foundation’s charitable registration number is 80622 2832 RR0001.
The Site, its charitable programs, and information collected through the Site are controlled by the Foundation unless a page expressly states otherwise. Third-party service providers may support particular functions, but they do not become operators of the Site or parties to these Terms solely by providing those services.
3. Eligibility and Use by Children
The Site includes educational content that may be viewed by children, families, teachers, and schools. However, donation forms, applications, resource requests, account features, and forms that collect personal information are intended to be completed by an adult or by a person authorized to act for a school, organization, parent, or guardian.
If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent, guardian, teacher, or other responsible adult. Children should not submit personal information, photographs, videos, or other content directly to the Foundation without appropriate adult authorization.
4. Changes to These Terms
We may revise these Terms from time to time. The revised version will be posted on this page with a new effective date. Changes apply from the date they are posted unless a different date is stated. Your continued use of the Site after a change means you accept the revised Terms.
5. Access to the Site
We may modify, suspend, withdraw, or restrict any part of the Site, program, resource, or feature at any time. We do not guarantee that the Site or any content will always be available, uninterrupted, secure, or error-free.
You are responsible for the equipment, internet connection, software, and arrangements needed to access the Site. You must ensure that anyone using the Site through your device or connection understands and follows these Terms.
Where the Site permits an account or password, you must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized use. We may disable an account or access credentials where reasonably necessary to protect the Site, its users, or the Foundation.
6. Educational Information and No Professional Advice
The Site provides general educational and charitable information about topics that may include gardening, food literacy, agriculture, pollinators, environmental stewardship, healthy eating, outdoor learning, and community programs.
Site content is not medical, nutritional, dietetic, legal, financial, safety, engineering, agricultural, or other professional advice. It is not intended to diagnose, treat, cure, or prevent any disease or health condition. Consult an appropriately qualified professional before relying on information that may affect health, diet, allergies, medication, safety, construction, land use, or legal rights.
Gardening, food preparation, farm visits, outdoor learning, and related activities can involve risks, including tools, soil, plants, insects, weather, allergens, food handling, and uneven surfaces. Responsible adults and participating organizations must assess local conditions, obtain required permissions, follow applicable safety rules, and provide appropriate supervision.
7. Programs, Grants, Applications, and Complimentary Resources
Program descriptions, eligibility requirements, application criteria, quantities, delivery dates, and availability may change. Submitting a request or application does not guarantee approval, funding, participation, delivery, or continued availability.
The Foundation may verify information, request supporting documentation, limit quantities, establish geographic or age-based eligibility, prioritize need, and decline or modify a request where resources are limited, information is incomplete, or the request does not align with program requirements.
Complimentary books, workbooks, seeds, activity materials, and other resources are provided for their stated educational or charitable purpose. Unless we give written permission, they may not be resold, commercially redistributed, or used in a way that suggests the Foundation endorses a product, service, political position, or organization.
8. Donations, Recurring Gifts, Purchases, and Payments
When you make a donation or purchase, you confirm that the information you provide is accurate and that you are authorized to use the selected payment method. Payments may be processed by a third-party payment provider whose terms and privacy practices also apply.
Official donation receipts will be issued only where the donation is eligible under applicable Canadian law and the Foundation has the information required to issue the receipt. Acknowledgements, event benefits, goods, or services received in connection with a contribution may affect receipting eligibility.
Donations are generally final. If you believe a donation was made in error, duplicated, or made without authorization, contact us promptly. Any refund or correction is subject to applicable law, tax-receipting requirements, payment-processor rules, and the circumstances of the transaction.
Recurring donations continue at the selected interval until cancelled. Cancellation stops future charges but does not automatically reverse past donations. Cancellation instructions may be available through the payment provider or by contacting the Foundation.
If the Site offers books, merchandise, event tickets, or other items, availability, pricing, shipping, taxes, returns, cancellations, and other transaction terms shown at checkout or on the relevant page will also apply.
9. Intellectual Property
The Site and its contents—including text, educational resources, stories, workbooks, illustrations, photographs, videos, logos, graphics, design, software, and arrangement—are owned by or licensed to the Foundation and are protected by applicable intellectual-property laws.
Plant a Seed & See What Grows Foundation, related names, logos, slogans, and program names are trademarks or other protected identifiers of the Foundation or their respective owners. No licence to use a name, logo, or mark is granted except where we provide express written permission.
10. Permitted Use of Site Materials
Subject to these Terms, you may view the Site and download or print a reasonable number of pages or educational resources for personal, non-commercial, classroom, library, or community-program use, provided that you:
- do not alter the material in a misleading way;
- retain copyright, trademark, credit, and other notices;
- do not sell, license, or commercially exploit the material;
- do not use the material to imply sponsorship or endorsement; and
- follow any additional instructions displayed with the material.
Any other reproduction, publication, adaptation, distribution, public display, commercial use, text-and-data extraction, or creation of derivative materials requires prior written permission unless permitted by law.
11. Prohibited Uses
You may use the Site only for lawful purposes. You must not:
- violate applicable law or the rights of another person;
- submit false, misleading, fraudulent, defamatory, discriminatory, abusive, obscene, threatening, or unlawful content;
- collect or attempt to collect personal information about children or other users through the Site;
- impersonate the Foundation, a school, a donor, another user, or any other person or organization;
- send spam, unauthorized fundraising solicitations, advertising, or promotional material through the Site;
- introduce malicious code, interfere with Site operation, bypass security, probe vulnerabilities, or gain unauthorized access;
- use automated tools to scrape, copy, monitor, or extract Site content or personal information without permission, except for standard search-engine indexing;
- frame, mirror, or reproduce substantial portions of the Site without permission;
- resell complimentary resources or apply for programs using false or duplicate identities; or
- use Foundation content, names, or logos to train, market, or promote a commercial product or artificial-intelligence system without written authorization.
We may investigate suspected misuse, preserve relevant information, remove content, restrict access, and cooperate with lawful requests from authorities.
12. Submissions, Testimonials, Photographs, and Videos
The Site may invite you to send comments, stories, feedback, testimonials, artwork, photographs, videos, or other materials (“Submissions”). Information sent privately through a contact, donation, application, or resource-request form is handled under our Privacy Policy and is not treated as public content merely because you submitted it.
When you intentionally provide a Submission for publication, promotion, reporting, fundraising, or sharing with the Foundation community, you grant the Foundation a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit for length or format, translate, display, publish, and distribute that Submission in connection with the Foundation’s charitable mission, programs, reports, websites, social media, and fundraising communications. You retain ownership of your Submission.
You represent that you have the rights and permissions needed to provide the Submission. If a child or another identifiable person appears in it, you confirm that all required parent, guardian, school, privacy, publicity, and copyright permissions have been obtained. The Foundation may ask for written proof of consent or a separate release.
Do not send confidential information, unnecessary sensitive information, or content that infringes another person’s rights. We may decline, edit, remove, or stop using a Submission. We will consider reasonable withdrawal requests, but removal may not be possible from materials already printed, distributed, archived, lawfully shared, or required to be retained.
13. Third-Party Content, Links, and Services
The Site may link to or embed websites, donation platforms, payment providers, social networks, videos, maps, forms, resources, sponsors, partners, or other third-party services. These are provided for convenience and do not necessarily mean that the Foundation endorses all content, products, services, or views offered by those third parties.
Third parties control their own services and privacy practices. We are not responsible for their availability, security, accuracy, content, or handling of personal information. Review their terms and privacy notices before using them.
14. Linking to the Site
You may link to the Site in a fair and lawful way that does not damage the Foundation’s reputation or falsely suggest association, approval, or endorsement. You may not frame the Site, obscure its branding, or use a link in connection with unlawful, misleading, or harmful content. We may withdraw linking permission.
15. Privacy
Our collection, use, disclosure, retention, and protection of personal information are described in the Foundation’s Privacy Policy. By using the Site or submitting information, you acknowledge that your information will be handled as described there.
16. Electronic Communications and Security
Messages sent over the internet may not be completely secure. Do not send payment-card numbers, health records, government identification, or other highly sensitive information by ordinary email unless we specifically provide a secure method.
We may communicate with you electronically about transactions, donations, applications, resource requests, security, program administration, and other matters related to your interaction with us. Marketing and fundraising communications will include applicable choices and unsubscribe options.
17. Accuracy and Changes to Content
We try to provide useful and accurate information, but Site content may contain errors, omissions, or outdated information. We may correct or update content without notice. Dates, statistics, program details, external links, and third-party information should be independently verified where they are important to a decision.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the Site and all content, resources, downloads, programs, and services made available through it are provided on an “as is” and “as available” basis. The Foundation does not make warranties that the Site will be uninterrupted, error-free, secure, suitable for a particular purpose, or free from harmful components, or that educational, gardening, fundraising, or program outcomes will meet your expectations.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
19. Limitation of Liability
To the maximum extent permitted by law, the Foundation and its directors, officers, employees, volunteers, agents, program partners, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of opportunity, loss of revenue, or loss arising from reliance on Site content, even if advised that such loss was possible.
The Foundation is not responsible for loss caused by third-party websites or services, unauthorized access, internet transmission, malicious code, Site unavailability, user conduct, or activities undertaken without appropriate professional advice, permissions, safety measures, or supervision.
These limitations do not apply to liability that cannot be excluded or limited under applicable law.
20. Indemnification
You agree to indemnify and hold harmless the Foundation and its directors, officers, employees, volunteers, agents, licensors, and service providers from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Site, your material breach of these Terms, your Submission, or your infringement of another person’s rights. This section does not require you to indemnify anyone for their own negligence or unlawful conduct.
21. Suspension and Termination
We may suspend or terminate your access to the Site, remove a Submission, cancel an application, or decline a request where we reasonably believe there has been misuse, a security risk, false information, a breach of these Terms, or conduct that may harm the Foundation, its programs, participating adults, children, schools, donors, partners, or other users.
Provisions that by their nature should continue—including intellectual property, Submissions, disclaimers, liability, indemnification, governing law, and privacy obligations—survive termination.
22. Geographic Availability
The Foundation is based in British Columbia, Canada, and many programs and resources are intended for Canadian participants. We do not represent that every Site feature, program, receipt, resource, or service is available or appropriate in every location. Users outside British Columbia are responsible for complying with local law.
23. Governing Law and Courts
These Terms and your use of the Site are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to any rights you may have under mandatory consumer or other laws, disputes relating to the Site or these Terms will be brought in the courts of British Columbia.
24. Waiver and Severability
If we do not enforce a provision immediately, that does not waive our right to enforce it later. If a court finds any provision invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.
25. Entire Agreement
These Terms, the Privacy Policy, and any additional terms presented for a specific activity form the entire agreement between you and the Foundation regarding the Site and replace prior discussions or understandings about Site use.
