Terms of Use<\/h2>

Plant a Seed and See What Grows Foundation \u00b7 Effective date: August 20th, 2026<\/em><\/p>

1. Acceptance of these Terms<\/h3>

These Terms of Use are entered into between you and the Plant a Seed and See What Grows Foundation (\u201cthe Foundation,\u201d \u201cwe,\u201d \u201cus\u201d). They govern your access to and use of seewhatgrows.us, including all content, functionality, and services offered on it (the \u201cSite\u201d). By using the Site, ordering free program resources, or submitting any form, you accept these Terms of Use and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.<\/p>

The Site is offered to users who reside in the United States. Forms and orders are intended for adults \u2014 by submitting them you represent that you are at least 18 and legally able to enter into this agreement.<\/p>

2. Changes to these Terms and to the Site<\/h3>

We may revise these Terms from time to time; changes take effect when posted, and your continued use of the Site means you accept them. We may also update, add, or remove Site content and programs at any time, and we may restrict or withdraw access to any part of the Site without notice. We are not liable if the Site is unavailable at any time.<\/p>

3. Free program resources<\/h3>

Our program kits \u2014 storybooks, workbooks, coloring books, and seeds \u2014 are provided free of charge to eligible U.S. schools and community organizations. When you submit a request form, you agree that the information you provide is accurate, current, and complete. All requests are subject to acceptance and availability, and we may decline or limit any request at our discretion. Resources are provided for educational use by your school, classroom, or organization \u2014 not for resale or commercial use. We deliver only to complete street addresses in the United States (no PO boxes).<\/p>

4. Our content and your use of it<\/h3>

The Site and its contents \u2014 including the storybooks, workbooks, coloring books, illustrations, characters, videos, text, and design \u2014 are owned by the Foundation or its licensors and are protected by United States, Canadian, and international copyright, trademark, and other intellectual-property laws.
We want our resources used! You may download, print, and reproduce our free PDFs and activity materials for personal, classroom, library, and other non-commercial educational use. You may not sell our materials, modify them or create derivative works from them, remove any copyright or credit notices, or use any illustration, character, or audio\/video content separately from its accompanying material. For any other use, ask us first: usa@seewhatgrows.us.<\/p>

5. Trademarks<\/h3>

\u201cPlant a Seed & See What Grows,\u201d the Foundation’s logos, and its program names (Seeds of Inspiration, Seedlings of Wonder, Plant a Seed\u2014Read!, Kids Corner) are trademarks of the Foundation. Other names and logos appearing on the Site belong to their respective owners. No license to use any trademark is granted by the Site.<\/p>

6. Acceptable use<\/h3>

You may use the Site only for lawful purposes. You agree not to: use the Site in any way that violates applicable law; attempt to exploit or harm minors in any way; impersonate the Foundation or any other person; send spam or promotional solicitations through the Site; introduce viruses or other malicious code; attempt to gain unauthorized access to the Site or its servers; use robots, scrapers, or other automated means to access the Site without our written consent; or otherwise interfere with the Site’s proper working or another person’s use of it.<\/p>

7. Submissions (contest entries, photos, testimonials)<\/h3>

From time to time we invite submissions \u2014 for example, Earth Day Art Contest entries, classroom photos, or testimonials (\u201cSubmissions\u201d). By making a Submission, you grant the Foundation a non-exclusive, royalty-free right to use, reproduce, and display it, with attribution, for the Foundation’s charitable and promotional purposes. You confirm that you own or control the rights to what you submit, that you have permission from any person appearing in it, and \u2014 for any work created by a child \u2014 that you are the child’s parent, legal guardian, or teacher with the parent’s consent. We may decline or remove any Submission at our discretion. Submissions must not contain unlawful, infringing, or objectionable material.<\/p>

8. Copyright complaints<\/h3>

We respect the intellectual property of others. If you believe material on the Site infringes your copyright, send a notice with the information required by the Digital Millennium Copyright Act (17 U.S.C. \u00a7 512) to: info@seewhatgrows.org.us\u00a0<\/p>

9. Information on the Site<\/h3>

The information on the Site is provided for general educational purposes. While we work to keep it accurate and current, we do not warrant its completeness, and any reliance you place on it is at your own discretion. Gardening and planting activities for young children should always be supervised by an adult.<\/p>

10. Third-party links<\/h3>

The Site links to third-party sites and services \u2014 including our donation platform, our online shop, and embedded videos \u2014 for your convenience. We do not control and are not responsible for their content or practices; your use of them is governed by their own terms and policies.<\/p>

11. Linking to the Site<\/h3>

You are welcome to link to the Site in a way that is fair, legal, and does not suggest endorsement or association without our written consent. We may withdraw linking permission at any time.<\/p>

12. Disclaimer of warranties<\/h3>

YOUR USE OF THE SITE AND ITS CONTENT IS AT YOUR OWN RISK. THE SITE AND ALL RESOURCES ARE PROVIDED FREE OF CHARGE, ON AN \u201cAS IS\u201d AND \u201cAS AVAILABLE\u201d BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 13. Limitation of liability<\/h3>

TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE, ANY SITE LINKED TO IT, OR ANY RESOURCES OBTAINED THROUGH IT, INCLUDING ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. 14. Indemnification<\/h3>

You agree to defend, indemnify, and hold harmless the Foundation and its directors, officers, employees, volunteers, and service providers from claims, damages, and reasonable costs (including attorneys’ fees) arising out of your violation of these Terms or your Submissions.<\/p>

15. Governing law and disputes<\/h3>

These Terms and any dispute arising from them or the Site are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any legal action shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction.\u00a0<\/p>

16. Waiver, severability, and entire agreement<\/h3>

Our failure to enforce any provision of these Terms is not a waiver of it. If any provision is held invalid or unenforceable, the remaining provisions continue in full force. These Terms and the Privacy Policy are the entire agreement between you and the Foundation regarding the Site.<\/p>
