It does not govern a third party\u2019s website, platform, or service, even when linked from our Site.<\/p><h3>2. Accountability and Applicable Law<\/h3><p>The Foundation is responsible for personal information under its control. We aim to handle personal information in accordance with applicable Canadian privacy law, including British Columbia\u2019s Personal Information Protection Act and the federal Personal Information Protection and Electronic Documents Act where applicable.<\/p><p>We designate a Privacy Officer to oversee our privacy practices, respond to questions and complaints, and coordinate access or correction requests. Contact information appears at the end of this Policy.<\/p><h3>3. What \u201cPersonal Information\u201d Means<\/h3><p>Personal information is information about an identifiable individual. Depending on the context, it can include a name, email address, telephone number, mailing address, donation history, school or organizational affiliation, application details, photographs, videos, online identifiers, or other information that can reasonably be linked to a person.<\/p><p>Information that has been aggregated or anonymized so that it cannot reasonably identify an individual is not personal information.<\/p><h3>4. Personal Information We May Collect<\/h3><p>The information we collect depends on how you interact with us and may include:<\/p><ul><li aria-level=\"1\">Contact and identity information, such as name, title, email address, telephone number, mailing address, province, language preference, and organization or school affiliation.<\/li><li aria-level=\"1\">Donation and transaction information, such as donation amount, date, campaign, payment status, billing contact, tax-receipt details, recurring-gift preferences, and purchase or order history. Payment providers generally process full payment-card details on our behalf; the Foundation does not need to store the complete card number.<\/li><li aria-level=\"1\">School and program information, such as school name, delivery address, grade level, class size, educator role, student counts, program needs, requested resources, and delivery instructions.<\/li><li aria-level=\"1\">Application and participation information, such as information submitted for bursaries, grants, volunteer roles, events, partnerships, garden programs, funded programs, or other opportunities.<\/li><li aria-level=\"1\">Communications and preferences, such as messages, questions, survey responses, feedback, newsletter choices, consent records, and records of our correspondence.<\/li><li aria-level=\"1\">Media and submitted content, such as testimonials, stories, photographs, videos, artwork, captions, names, social-media handles, and permissions associated with those materials.<\/li><li aria-level=\"1\">Technical and usage information, such as IP address, browser and device information, pages viewed, referral source, approximate location derived from IP address, timestamps, cookie identifiers, and interactions with emails or Site features.<\/li><li aria-level=\"1\">Other information you choose to provide or that we identify at the point of collection.<\/li><\/ul><p><br \/>Please do not provide sensitive information that is not needed for the relevant program or request.<\/p><h3>5. How We Collect Information<\/h3><p>We may collect personal information:<\/p><ul><li aria-level=\"1\">directly from you when you complete a form, donate, order resources, apply, register, communicate with us, attend an event, subscribe, or provide a Submission;<\/li><li aria-level=\"1\">from a parent, guardian, teacher, school, organization, fundraiser, event organizer, or other authorized representative;<\/li><li aria-level=\"1\">automatically through cookies, logs, analytics, and similar technologies when you use the Site;<\/li><li aria-level=\"1\">from service providers that process donations, registrations, deliveries, communications, or other activities for us; and<\/li><li aria-level=\"1\">from publicly available sources or program partners where permitted by law and reasonably connected to our charitable activities.<\/li><\/ul><p><br \/>If you provide personal information about another person, you confirm that you have authority to do so and have given any notice or obtained any consent required by law.<\/p><h3>6. Why We Use Personal Information<\/h3><p>We may use personal information to:<\/p><ul><li aria-level=\"1\">operate, maintain, secure, and improve the Site and Services;<\/li><li aria-level=\"1\">respond to questions, requests, complaints, and technical issues;<\/li><li aria-level=\"1\">process donations, recurring gifts, purchases, refunds, acknowledgements, and tax receipts;<\/li><li aria-level=\"1\">assess and administer resource requests, school programs, garden initiatives, grants, bursaries, events, volunteer opportunities, partnerships, and applications;<\/li><li aria-level=\"1\">verify eligibility, prevent duplicate or fraudulent requests, allocate limited resources, and coordinate fulfilment or delivery;<\/li><li aria-level=\"1\">communicate with donors, educators, applicants, volunteers, partners, supporters, and participants;<\/li><li aria-level=\"1\">send newsletters, fundraising appeals, program updates, event invitations, or other communications where permitted by law;<\/li><li aria-level=\"1\">publish or share stories, testimonials, photographs, and videos where appropriate permissions have been obtained;<\/li><li aria-level=\"1\">measure participation, evaluate impact, prepare reports, understand Site use, and improve our programs;<\/li><li aria-level=\"1\">protect the safety, rights, property, and integrity of the Foundation, program participants, children, schools, donors, partners, and the public;<\/li><li aria-level=\"1\">comply with legal, regulatory, tax, accounting, audit, insurance, grant, and record-keeping obligations; and<\/li><li aria-level=\"1\">carry out another purpose that we explain at the time of collection or that is permitted or required by law.<\/li><\/ul><p><br \/>We may use aggregated or anonymized information for research, evaluation, reporting, planning, and communications.<\/p><h3>7. Consent and Your Choices<\/h3><p>We collect, use, and disclose personal information with consent where consent is required. Consent may be express or implied, depending on the sensitivity of the information, the reasonable expectations of the individual, and the circumstances.<\/p><p>You may decline to provide optional information. If information is necessary to process a donation, issue a receipt, deliver resources, assess an application, confirm permission, or administer a program, we may be unable to complete the request without it.<\/p><p>You may withdraw consent for future use or disclosure, subject to reasonable notice and legal, contractual, operational, or record-retention requirements. Withdrawal does not invalidate handling that occurred before the withdrawal.<\/p><h3>8. Children and Young People<\/h3><p>Some Foundation content and programs are designed for children, but Site forms that collect personal information are generally intended to be completed by adults, educators, schools, or authorized representatives.<\/p><p>We do not knowingly ask a minor under the age of majority to provide personal information directly through general Site forms without appropriate parent, guardian, teacher, or school involvement. If we learn that personal information was submitted directly by a child without appropriate authorization, we will take reasonable steps to delete it or obtain the required consent.<\/p><p>Photographs, videos, names, stories, or artwork that identify a child should be submitted only where all required parent, guardian, school, and organizational permissions have been obtained, and where appropriate. We may require a separate media release and may decline to publish identifying content involving a child.<\/p><p>A parent or guardian may contact us to ask about, correct, or request deletion of a child\u2019s personal information, subject to legal and operational requirements.<\/p><h3>9. Cookies, Analytics, and Similar Technologies<\/h3><p>The Site may use cookies, pixels, local storage, server logs, and similar technologies. These technologies may be used to:<\/p><ul><li aria-level=\"1\">enable essential Site functions and security;<\/li><li aria-level=\"1\">remember language, accessibility, or cookie preferences;<\/li><li aria-level=\"1\">understand traffic and how visitors use the Site;<\/li><li aria-level=\"1\">measure the effectiveness of communications or campaigns;<\/li><li aria-level=\"1\">support embedded videos, maps, social-media tools, donation forms, or other third-party features; and<\/li><li aria-level=\"1\">identify and address errors, misuse, or security threats.<\/li><\/ul><p><br \/>Some cookies are placed by third-party service providers. Those providers may collect information under their own privacy policies. Where a cookie banner or preference tool is available on the Site, you can use it to accept or reject non-essential cookies.\u00a0<\/p><p>You can also manage cookies through your browser. Blocking certain cookies may affect Site functionality. We do not sell personal information, and we do not knowingly use children\u2019s personal information for behavioural advertising.<\/p><h3>10. When We Disclose Personal Information<\/h3><p>We may disclose personal information in the following circumstances:<\/p><ul><li aria-level=\"1\">Service providers. We may use providers for website hosting, cloud storage, cybersecurity, email delivery, donor or constituent management, payment processing, accounting, receipting, shipping, printing, analytics, surveys, application management, events, and technical support.<\/li><li aria-level=\"1\">Operational support providers. Where third parties provide authorized administrative, technical, communications, fulfilment, accounting, or program support, they may receive limited personal information needed to perform those services. They must use that information only for the authorized purpose and subject to appropriate contractual, confidentiality, and security safeguards.<\/li><li aria-level=\"1\">Program and delivery partners. We may share information with a school, courier, community organization, funder, event venue, garden partner, evaluator, or other participant where needed to provide a program or complete a request and where the sharing is reasonably expected or separately authorized.<\/li><li aria-level=\"1\">Professional advisers and oversight. We may disclose information to auditors, legal counsel, insurers, financial institutions, regulators, or government authorities as reasonably necessary.<\/li><li aria-level=\"1\">Legal and safety reasons. We may disclose information where required or permitted by law, to respond to lawful process, to investigate fraud or misuse, to protect a person\u2019s safety, or to protect the rights and property of the Foundation or others.<\/li><li aria-level=\"1\">Organizational transition. If the Foundation restructures, transfers a program, changes service providers, or winds down a service, information may be transferred as permitted by law and subject to appropriate protection.<\/li><\/ul><p><br \/>We do not rent or sell donor, member, school, or participant lists. We do not permit service providers to use personal information for their own unrelated marketing merely because they process information for us.<\/p><h3>11. Processing and Storage Outside Canada<\/h3><p>Some service providers may store or process information in another province, the United States, or another country. Personal information in another jurisdiction may be subject to that jurisdiction\u2019s laws and may be accessible to courts, law-enforcement bodies, or national-security authorities there.<\/p><p>When using service providers, we take reasonable steps appropriate to the sensitivity of the information to require privacy and security protections. You may contact our Privacy Officer for information about our use of service providers outside Canada.<\/p><h3>12. Email, Newsletters, and Fundraising Communications<\/h3><p>We may send service or transactional messages related to a donation, receipt, application, resource request, delivery, event, security matter, or program in which you are involved.<\/p><p>We may also send newsletters, fundraising appeals, program news, or promotional messages where permitted by law. Where required, we will seek consent, identify the sender, and provide a working unsubscribe method. You may unsubscribe using the link in the message or by contacting us. Unsubscribing from marketing does not prevent us from sending necessary transactional or administrative messages.<\/p><h3>13. Retention and Disposal<\/h3><p>We retain personal information only as long as reasonably necessary for the purposes described in this Policy and to meet legal, tax, accounting, audit, insurance, grant, dispute-resolution, and record-keeping requirements.<\/p><p>Retention periods vary according to the type of information. Donation and receipting records may need to be retained longer than routine inquiries. Unsuccessful applications, media permissions, delivery records, and consent records may have different retention periods.<\/p><p>When personal information is no longer required, we take reasonable steps to delete, destroy, or anonymize it. Backup copies may remain for a limited period until securely overwritten or deleted in the ordinary course.<\/p><h3>14. Safeguards<\/h3><p>We use administrative, technical, and physical safeguards that are reasonable in light of the sensitivity, amount, format, and location of the information. Measures may include access controls, role-based permissions, contractual confidentiality, staff or volunteer guidance, secure service providers, encryption where appropriate, backups, monitoring, and secure disposal.<\/p><p>No system or transmission method is completely secure. You should use caution when sending personal information by email and should not send full payment-card details, health records, government identifiers, or other highly sensitive data unless we provide an appropriate secure method.<\/p><p>If we become aware of a privacy or security incident, we will investigate and take steps required by applicable law, which may include containment, notification, record keeping, and improvements to safeguards.<\/p><h3>15. Access, Correction, and Questions<\/h3><p>You may request access to personal information we hold about you and ask us to correct information that is inaccurate or incomplete. We may need to verify your identity before responding.<\/p><p>Access may be limited where permitted or required by law, including where disclosure would reveal another person\u2019s personal information, confidential commercial information, privileged information, or information collected for an investigation. If we cannot provide access, we will explain the reason where legally permitted.<\/p><p>You may also ask how your information has been used or disclosed and may raise a concern about our privacy practices. We will respond within the time required by applicable law or within a reasonable period where no specific period applies.<\/p><h3>16. Deletion and Withdrawal Requests<\/h3><p>You may ask us to delete information or withdraw consent. We will assess the request in light of legal obligations, tax-receipting rules, active transactions, program administration, fraud prevention, freedom of expression, existing publications, and other legitimate requirements.<\/p><p>We may be unable to remove information from printed reports, materials already distributed, archived public records, third-party platforms outside our control, or records that law requires us to retain. We will explain material limitations where appropriate.<\/p><h3>17. Third-Party Websites and Social Media<\/h3><p>The Services may link to or use third-party sites and platforms, including donation processors, payment services, video hosts, social networks, mapping tools, event systems, and partner websites. Their privacy policies apply to information they collect for their own purposes.<\/p><p>Information you post publicly on a social network or public page may be viewed, copied, or shared by others. Use privacy settings and avoid posting personal information about children or other people without permission.<\/p><h3>18. Changes to This Policy<\/h3><p>We may update this Policy to reflect changes in our Services, technology, service providers, programs, or legal obligations. The updated version will be posted with a revised effective date. If a change materially affects how we use information already collected, we will provide additional notice or seek consent where required.<\/p><h3>19.
